U.S. District Court Judge Richard Posner in Chicago this week backed away from dismissing entirely a trial set to occur between Apple and Motorola. The judge decided to give both companies one more chance to argue for injunctions against each other. Last week, Posner tossed the trial, saying neither could prove damages. He has scheduled an injunction hearing for June 20. Posner will make a final decision after hearing the arguments. The change in tactics protects the judge from a legal standpoint if the case is appealed.
