Judge Lucy Koh will review Samsung's complaints about the foreman of the jury that delivered a $1 billion patent judgement against it. Samsung accused the foreman of misconduct. Koh's order read, in part, "The Court will consider the questions of whether the jury foreperson concealed information during voir dire, whether any concealed information was material, and whether any concealment constituted misconduct." The discrepancy pertains to the foreman's past relationship with technology companies and his involvement in litigation between them. He was at one point employed by Seagate and sued by the company. Samsung says that it has a "substantial strategic relationship" with Seagate and that the foreman should have disclosed this prior relationship. Samsung was convicted of infringing on Apple's smartphone patents in the trial, which concluded in August. Koh will review the foreman's conduct during a scheduled December 6 hearing.
